Terms of Sales
These general conditions of sale are concluded between, on the one hand, this website www.opahkworld.com published by the company OPAHK SARLs, registered with the RCS of Luxembourg n ° B269598 and whose intra-community VAT number is LU34131500 and on the other hand, any non-commercial natural person ("Customer") wishing to make a purchase on the website www .opahkworld.com
OPAHK SARLs owns the OPAHK brand. OPAHK is therefore subject to the same general conditions.
I. PURPOSE
These conditions are intended to define the terms of ordering, payment, delivery but also after-sales service between opahkworld.com and the customer.
II. PRODUCTS
All products for sale on the site www.opahkworld.com are offered within the limits of available stocks. The products available on the site are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, OPAHK SARLs cannot be held liable. The photographs of the products offered may undergo minimal variations (colors, sizes, shapes).
III. ORDER PROCESS
The customer can choose items from our product range and put them in his “Basket”. By clicking on the "Finalize the order" button, the customer finalizes the order of the products appearing in the Basket. He will then be asked to provide us with the data concerning him (including the data relating to the payment). Before finalizing an order, the customer can at any time view and modify the details of his order. It is also mandatory to accept these T&Cs before placing an order. Otherwise it will not be possible to order products on the Website. Placing your order constitutes a sales contract between the customer and the company, subject to the availability of the products ordered. A confirmation email will be sent to the customer confirming receipt and details of the order.
IV. SHIPPING – DELIVERY
All our parcels are sent via the services of B-POST and MONDIAL RELAY. The Shipping Costs for any order placed in Belgium are fixed and indicated by the seller in the form completed when placing the Order. All lead times announced are calculated in working days. The Seller undertakes to process the Order within thirty days from the day following the validation of the Order. The times indicated are average times and correspond to the times for processing, preparing and shipping the order (out of warehouse). They run as soon as the order is validated.
V. SHIPPING
All purchased items are dispatched within 10 business days of ordering, although most items are dispatched within 3-4 days. Your delivery can take up to 2 weeks in case of high traffic. If you still have not received your purchase after 3 weeks, please write to us at shop@opahk.com.
Once your order is confirmed, you will receive an email from us.
VI. RESPONSIBILITY
OPAHK SARLs is not responsible for any loss or damage you may suffer if such loss or damage results from a case of force majeure, if it is attributable to the unforeseeable act of a third party, or if it is accountable.
VII. RIGHT TO RETRACT
According to Article L.l21-20 of the Consumer Code, all consumers have a period of 14 days to exercise their right of withdrawal without having to justify reasons or pay penalties, with the exception return costs. This period is extended until the 1st following working day, if it expires on a Saturday, a Sunday or a public holiday. Products must be returned in their original packaging and condition. VIII. PRICE - PAYMENT TERMS
Product prices are displayed in euros. VAT is included in the displayed price at the rate in force in Luxembourg and in the countries of the European Union for the products concerned. For orders destined for countries outside the European Union, VAT will be deducted from the prices displayed. However, the regularization of customs and VAT charges will, if necessary, be requested from the Customer on delivery by the competent authorities of the country of delivery.
IX. SECURE PAYMENT
The site offers the possibility of paying with several means and interfaces.
Payments by STRIPE:
We have no access to your identifiers and credit card numbers. All transactions are secured using SSL encryption, guaranteeing you both the identity of the payment organization and the confidentiality of the data.
Payments by PAYPAL:
They are provided by the PayPal interface. It is a simple and secure payment solution for accepting payments by credit card or through a PayPal account. By using PayPal as a means of payment to pay for a purchase, you are covered by the service provider's guarantees, which you will find on its website.
Termination
Any termination of the T&Cs which bind the Seller and the customer, entails the termination of the T&Cs between Stripe and the customer.
X. GUARANTEES - AFTER-SALES SERVICES
All the Products for sale on the Website benefit from the legal guarantee of conformity (L211-4 of the Consumer Code) allowing the User to return the products delivered which are defective or non-compliant. -Article L2ll-4 of the Consumer Code: The seller is required to deliver a compliant good existing at the time of delivery. XI. BACK AND TRADES
If within 14 days from the date you received your package you are not satisfied with your order, you can return it to us for an exchange. Products must be returned in their packaging, folded as best as possible, and in their original condition (unworn, unwashed, unscented, no hair, no hair, etc.).
Be sure to include a copy of your order confirmation email to expedite the processing of your request. Please attach a letter explaining what changes you wish to make, this will allow us to expedite the process. Upon receipt of the package, we will replace it.
If you are shipping an item you should consider using a trackable shipping service or purchasing shipping insurance. We do not guarantee that we will receive your returned item.
If you wish to return your order for a refund, please note that you will not be refunded the original postage costs unless an error has been made by OPAHK SARLs.
Sale items are neither exchangeable nor refundable.
XII. INTELLECTUAL PROPERTY
All elements of the Website, including the underlying technology, are protected by copyright, trademarks or patents. Similarly, the trademarks, logos, designs and models appearing on the website are the exclusive property of OPAHK SARLs and its partners. They cannot therefore be used under penalty of being considered counterfeit.
XIII. PERSONAL DATA
By providing information on the Website, you warrant that you are using your true identity and that all information provided is true, accurate, current and complete at the time you provide such information to us. The customer is informed that during his navigation and within the framework of the Order, personal data concerning him are collected and processed by the company OPAHK SARLs. This processing is the subject of a declaration to the National Commission Computing and Freedoms in application of law n-78-11 of January 6, 1978.
XIV. APPLICABLE LAW
The Conditions are governed by LU law. In the event of a dispute, only LU law applies and the competent court is that of the Commercial Court of LUXEMBOURG.
